In considering the language of HB13-1224, we have consulted with the Office of the Attorney General and we concur with its advice that the large-capacity magazine ban should be construed narrowly to ensure compliance with the requirements of the Second Amendment and the Due Process Clause of the 14th Amendment. In short. these clowns took Michael Bloomberg at his word that the boilerplate laws were reasonable, Constitutional and good for what ails ya! What they didn't do is either read the laws they introduced — and after 5 days at the state capitol talking to the people who introduced these laws, I'm not entirely convinced they could read them, certainly not without moving their lips. I have NEVER met a less impressive group of individuals in my life! They also made the decision — well, they actually just followed Bloomberg's 4 full-time paid lobbyists' script — and ignored any criticism of the Bloomberg boilerplate because, you know, Michael Bloomberg wouldn't lie, would he?
Now they're walking it back all over the place, because the laws are disasters, designed solely to punish innocent citizens for "technical" infractions. They are also starting to realize that these laws are not going to pass Constitutional muster. Here's our "caring" Governor:

I think the potential for damage seems to outweigh the inconvenience.”Here's the "inconvenience" the Governor is talking about — arrest for possession of a magazine with a capacity of greater than 15 rounds or a magazine that can be readily converted to such, confiscation of your vehicle (if the magazines were found in a vehicle or any other reason the police can think of), the magazines and your firearms, a trip to jail where you'll be booked, fingerprinted and thrown into a cell until you can reach your criminal attorney, who will charge you a "standard" retainer of $10,000 and arrange your bail. Eventually, you'll go before a judge, who will ask your attorney for a plea — innocent — and do you have a defense? You will say yes, I owned the magazine prior to 1 July 2013, and the judge will say, "No harm; no foul; you're free to go."
Of course, you've got to pay your attorney, and because your car, guns and magazines were "seized for cause," that is, the property was confiscated because you in fact broke a law, you will probably get your car back, but Denver and surrounding municipalities have a policy that NO guns "seized for cause" will be returned.
That's the minor "inconvenience" that the Governor says is definitely worth inflicting on law-abiding Colorado citizens for a law that will, according to B-Ho's own Justice Department says will have NO EFFECT WHATSOEVER on crime.
That John Hickenlooper, what a guy! I so look forward to voting against him!

ReplyDeleteHaving nothing to do last week, I actually listened for HOURS the Colorado Senate floor debate. At first, I thought it was me! Then I realized that these elected officials were absolute morons. They sounded less intelligent than my garage mechanic on a bad day. The pinnacle of stupidity was when one genius got up and started addressing a different bill. When chided by the Senate President (the lady enforcing the rules) the Senator just did a Roseanne Roseannadanna. Nevermind, picked up her papers and walked away from the lectern. Hilarious that these folks tell US how to live.
Time to relocate to AZ!

ReplyDeleteI think the solution is simple. wait for law to pass. Toss magazines into car of asshat that voted for this crap. Call police on them, and we have poetic justice. Do this 3 times and watch the magic of repeal. Bonus of politicians in jail. Yes it's evil, bit so are they.

Michael, I hear you talk about campaigning against and voting against the enemy. I hear you talking about buying land in a free state. I hear you talking about no more filming in Co. I haven't heard a serious rant about Michael packing his sh/t and moving. How bad does it have to get? Moving Sucks. Sitting in jail after spending the equivelant of down payment money on your defense sucks more. At this point what will it take to make the secret hidden bunker a fond memory?

And, as far as I'm concerned, if a firearms-related business stays in Colorado I'll spend my money somewhere else. Yes, I understand this was not of your making, and you are, as Magpul correctly identified, "in occupied territory." Nonetheless, staying in Colorado means you are supporting the evil regime with your tax dollars.

I awakened this morning thinking about Anonymous' comment to enforce these laws against those politicians that gave it to us. ReplyDeleteLet us start a conversation, then a campaign—calling for the strict enforcement of these laws—starting with those legislature members who voted for them. Let them taste the results of their own stupidity. Then maybe those helpful idiots that supported those dastardly politicians by voting them into office.
Maybe if the sheriffs of Colorado announced their intention to do so, these politicians might get a clue and repeal them before they become enforceable. Actually arresting and jailing them might be the best way to protect them.
Can I get registered to vote absentee in Colorado from Maine?.. If i just say i dont have an ID, and it is unfair to ask me for one, will that be enough to get by any inconvienient voting requirements? Maybe, we too, can play their filthy game!

ReplyDeleteThey also turn victims into survivors. Restrictions on armed self-defense will always kill more people than they save.
If our best defense is “inconvenience” or “no effect whatsoever on crime” or even confiscation of legally purchased property, we'll lose every time. We must argue that gun controls kill innocent law-abiding civilians by impairing their ability to legally defend themselves.
This is what the fight is really about: our opponents want to abolish the right to self-defense.
